By downloading, accessing, or purchasing any computerized embroidery design file (.EMB, .DST, .PES, .JEF, .EXP, .VP3) from EmbDesign (https://embdesign.io), you agree to be bound by the following terms and commercial licensing conditions.
1. Commercial Production Rights (What You Can Do)
Every design purchased from EmbDesign grants you a Perpetual, Non-Exclusive Commercial Manufacturing License:
- You are licensed to stitch the designs onto physical garments, sarees, blouses, lehengas, kurtis, dupattas, caps, patches, and textiles for physical sale to your clients without limit.
- You may run the files on single-needle boutique machines or multi-head industrial factory setups (Tajima, Barudan, SWF, etc.).
- You may adjust sizing by ±15% or modify thread colors to match your client's fabric requirements.
2. Prohibited Uses (What You Cannot Do)
To protect the intellectual property of our punchers and studio, the following acts are strictly prohibited:
- No Digital Resale: You may NOT resell, sub-license, donate, or distribute the raw machine embroidery files (.EMB, .DST, .PES, etc.) or vector outlines in any digital form.
- No File-Sharing Groups: You may NOT upload our files to Telegram public groups, WhatsApp groups, Google Drives, or torrent networks for mass distribution.
- No Digital Marketplace Uploads: You may NOT upload designs to competing embroidery websites or digital marketplaces.
3. Digital Delivery Protocol
All products sold on embdesign.io are intangible digital goods. Upon payment verification:
- Download access is released immediately on your order confirmation screen and delivered to your registered Telegram account (@embdesign71) or email.
- Every ZIP package contains all multi-needle and boutique formats: Tajima (.DST), Wilcom Native (.EMB), Brother (.PES), Janome (.JEF), Melco (.EXP), Husqvarna (.VP3).
4. 100% File Integrity & Replacement Policy
Because digital embroidery files are delivered immediately and cannot be "returned", all completed digital sales are final. However, we provide a 100% File Integrity Guarantee:
- File Corruption or Loading Errors: If a downloaded file fails to load on your machine controller, contact our technical desk at embdesign71@gmail.com or Telegram @embdesign71. We will repair, re-punch, and replace the file free of charge within 2 business hours.
- Accidental Duplicate Purchases: In the event of an accidental duplicate transaction for the same design SKU, a full refund will be issued within 3–5 business days.
5. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or related to these terms shall be subject to the exclusive jurisdiction of the competent courts in Surat, Gujarat, India.
